Miguel Perez Jr. when he was in the Army and America pretended he mattered

Another turn of the New Cruelty screw: Miguel Perez, Jr., 39, a green card holder who has been in the USA since he was eight years old, is facing deportation because he’s one of those criminal aliens we’re all supposed to be terrified of. Perez joined the Army in 2001 and served two tours of duty in Afghanistan, and he mistakenly thought taking his oath to defend the nation made him a citizen, but it didn’t. He could have applied for expedited citizenship, but didn’t since he didn’t look into the details. He also says his superiors in the military never offered him any help with becoming a citizen.

After three judges from the 7th U.S. Circuit Court of Appeals turned down his request to stay in the US last week, he announced Wednesday that he would begin a hunger strike. He believes that if he were sent back to Mexico, he’d be targeted by drug cartels, who seek out combat veterans to join them. If he were to refuse, he believes he’d be killed. That argument didn’t convince the three-judge appeals panel, which decided he needs to be deported.

“If it comes down to me being deported, I would rather leave this world in the country I gave my heart for,” Perez said in an interview from the detention center where he has been in custody for the last year.

After returning from Afghanistan, Perez was diagnosed with PTSD and was supposed to get tested to determine whether he’d suffered a traumatic brain injury, but before that testing got started, he was arrested in 2008 for a drug charge when he was caught trying to sell cocaine to an undercover cop. He accepted a plea deal and pleaded guilty to delivering less than 100 grams of cocaine. He had also received a general discharge from the Army (one step down from an honorable discharge), after an infraction for drugs. If he’d been naturalized, those offenses would have meant a 15-year sentence and difficulty getting a job. But since Perez only has a green card, that makes him a bad hombre and exactly the kind of dangerous scum we must sweep from our nation. Perez only discovered that he really wasn’t a citizen when he was finished with half his sentence and eligible for release in 2016. ICE took him straight from prison to a detention facility in Wisconsin, and he learned he’d been ordered to be deported to Mexico. He’s not entirely out of options just yet, and may ask for an en banc hearing of the full appeals court. Perez’si attorney, Chris Bergin, is also trying to get his deportation stayed after a medical evaluation found he needs immediate treatment for his PTSD and likely brain injury. Bergin is also seeking a grant of citizenship retroactive to 2001, when Perez enlisted.

For all the good it may do — and it may be very little — Perez’s supporters are petitioning Illinois Gov. Bruce Rauner to pardon Perez on the drug charge, although ICE would probably see the arrest alone as sufficient to justify deporting him. Everyone’s a criminal if you look at them hard enough.

Now, mind you, if you talk about this disgusting perversion of what we used to call the American Dream on Twitter, you’ll find any number of folks who’ll helpfully point out that the deportation order goes back to Obama’s presidency, so you’re not allowed to say anything about Donald Trump’s drive to deport as many dirty foreigns as humanly possible. You see, somehow, since you’re a liberal and you looove Obama, you wouldn’t have thought twice about this if Obama deported a veteran, and you don’t really like the troops either, and you’re only mad because Trump is president and YOU LOST. No, don’t try to say this would be inhuman even if Obama were still president, because you’re only able to think in partisan terms, you America hater.

        It’s been quite a while since I served, and I was AF in peacetime, not Army in war, so maybe there’s a difference, but I remember quite a bit of testing (for smarts and insanity), and background investigations for security clearannce, so I don’t think so, but my experience is pretty limited.

        There is a criminal background check for all enlistees. A felony conviction is an automatic nogo. Additionally, most enlistees must eventually pass a security check. The military can also see sealed juvenile records, sealed first offender records as well as expunged criminal records that wouldn’t be available to employers. The rules are even tighter for non-citizens.

      Seriously, with new clients, you have to start getting half up front, the remainder due when services are delivered. It’s easier to start with new clients, and then at some point send out a message to each existing client that payment processing is changing. By then you’ll be able to ask without fear. I have a small business, and we used to spend 10% of our time chasing customers for payment, or sitting with finished product that never got picked up (or paid for). Several years ago we began asking for half up front, and no one ever blinked an eye. They have to pay up front on the internet, so they are conditioned to pay all or half if requested. If your service involves once-monthly recurring payments, change it to 2 payments per month, due on the 15th and 30th. No payment received by the 15th? No additional work performed until payment is received. As you say, waiting for payment for services already performed is grueling. It is also bullshit. They aren’t going to change unless you change the rules, unfortunately. Also, anyone who balks was planning to screw you anyway, so fug ’em.

            Try this on for size: Nobody here — especially not me and I wrote the goddamn piece — is saying Mr. Perez is a perfect person. But being an American isn’t about being perfect. For serving his country and getting his brain and pscyche shattered in the process, Mr. Perez has at the very least earned a second chance like we’d give any citizen who’d served out their prison time.

            If we only care about injustice to ideal role models, then we don’t have to care about justice at all, ever. Consider Jorge Garcia, deported earlier this month after being brought to the US when he was 9, 30 years ago. Garcia never had so much as a traffic ticket. He was too old to qualify for DACA, And despite being a fairly ideal example, people still insisted deporting him was perfectly justified, because didn’t he break the law every day he worked, HMMMM? Clearly a criminal.

          I always respected mechanics. Every time I worked on a tractor or some farm vehicle, I would end up smashing my fingers or losing pieces of skin when a tool slipped, etc. Or, I would over-tighten and subsequently break a fitting or fastener and then have to fix that. Or drop some heavy object on my foot or onto some other object, breaking that.

    While I don’t stoop to felate every soldier I see, I think service should equal citizenship. It’s not like they just put on some fatigues and march around for a while, especially when they’ve been in actual combat. It’s amazing to me that people aren’t more outraged when people get deported after serving. Actually, no. No it doesn’t.

    I feel really bad about this man’s ordeal, but I have a question; He only had a Green card, he wasn’t allowed to vote, he didn’t have an American passport, why did he assume that he was a citizen? When you become an American citizen you receive a citizenship certificate, I should know because I have one.

            People rely on rumor. Remember how the GOP called Hillary a liar and claimed Trump was always truthful? If anyone believed that, it’s easy to think someone could believe that simply being in the military grants you either citizenship or permanent residency. By the end of the campaign, some news stations had fact checkers in real time grading Trump, and he failed invariably. But a whole lot of people still believed his lies.

      My guess is that he may have heard, again and again, that if you join the Army, you get citizenship, and he assumed that was true without following through. Lots of people assume citizenship is magically granted like that, like those who wondered how Jorge Garcia, could be married to a citizen but ineligible for a green card.

      People should know better, but they often don’t.

        Sort of like that bit Jon Stewart did about joining the Army and then applying the training you get there to the civilian work force. How recruits possibly have gotten the idea that their military training would apply? It’s in the ads. I would not put it past recruiters to put that forth in their pitch to get this kid to join the military, they have enough brass balls to put other lies in their public ads.

          my command put me in for a medal for meritorious service despite my having separated after my three active duty years were over, and really I wouldn’t have given a crap if they didn’t (it was routine but still, they didn’t have to.) They did take their sweet time, however, releasing me from the threat of being reactivated.

      In my case, I’m kind of glad the Army decided to discharge me rather than try to treat my Graves disease (a form of hyperthyroidism), as I’m pretty sure they would have just made things worse. But then, I had parents who could and did pay for testing and several rounds of radiation to eventually murder that pesky thyroid. It would suck to have something serious like PTSD, and not have a decent support network.

        The only thing I like about Rauner is that he’s the Governor who started licensing MM facilities, while the DINO(Pat Quinn) before him did absolutely nothing about licensing patients for MM, and sat on the licenses for dispensaries. This is one of the many reasons I hate Blue Dog Dems.

    I have long thought that if you serve in the military you should just be granted citizenship after some period of time. You shouldn’t even have to apply for it. Make it an opt-out thing if someone doesn’t want to do it. The govt knows who you are, they’ve already background checked you, and they have a record of your behaviour for several years. They have already proven their patriotism.

  • I’m just a coastal liberal elite here, but could someone explain to me how it’s even possible that someone’s family has been in this country over 100 years and NOBODY has been in any branch of the armed services (not counting military school). As the daughter/sister/niece/cousin/daughter-in-law etc of veterans, I’m a little confused.

It was great fun to bang on rural farm doors as a Vietnam vet for George McGovern. Some of the initial facial expressions were totally priceless and they’d then typically be polite, listen and take the flyer. Good times.

      My step-son wants to be an admiral and ‘drive an aircraft carrier.’ I think that’s great. If he told me he wanted to join the infantry, I’d tackle him at the door to the recruiter.

      On the other hand, we’ve lost a normal, familial connection to the military. It’s not good

      Really. I’m a New York Jew, and I have cousins who served, as well as an uncle (my dad had an Ordinary Seaman’s card, but never shipped out, and should have been classified 4F for diabetes).

      I also have a cousin who was a conscientious objector. His brother went to Vietnam and got malaria. All the Trumps are cowards and creeps.

    His post service behavior is not uncommon for many of today’s vets. Assistance needs to be available quickly and professionally instead of incarceration and criminal stigma. Any immigrant admitted into our military and serves a full term should have direct route to citizenship. How many of our “citizens” have opted to allow others to volunteer and protect our country?
