Betsy DeVos, as Secretary of Education, is very concerned about sexual assault on college campuses. Though, uh, perhaps not the way the rest of us are concerned. She has set up meetings with several “Men’s Rights” groups to discuss the “epidemic” of mean women lying about sexual assault just to ruin the lives of nice frat boys.

Which, really, is not an actual thing.

Despite the fact that sexual assault survivor groups have been pressuring DeVos for a meeting, the Department has instead reached out to the groups National Coalition for Men, SAVE: Stop Abusive and Violent Environments, and Families Advocating for Campus Equality — all of whom are very concerned. About THE MEN.

While those last two sound like they are actually advocating for GOOD things, they are not. SAVE is included in a list compiled by the Southern Poverty Law Center of groups that promote misogyny, and their goal is basically to make things as horrible for those who report assault as is humanly possible. For instance, they published a swell article (we wouldn’t click if we were you) in which they claimed that domestic violence laws violate their “civil right” to “family privacy.” Because, I guess, they feel it is their business and not the government’s if they want to beat their wives and children.

The article also whines about the fact that prosecutors are discouraged from asking about an accuser’s prior sexual behavior and ought to be able to ask “detailed, often intrusive questions about the accuser’s prior sexual history.” The reason, of course, that this is discouraged is because it doesn’t even make sense. Because you can have sex with 100 people and still say no to someone else.

The group also pines for the days when the rapist, not the victim, got to say whether or not it was rape:

Guilty Mind (“mens rea”): Criminal law has long held that if a man believed in good faith that the woman was consenting to intercourse, then he could not be found to have committed rape. Now, that requirement has been largely removed.

And they didn’t have to be all 100% sure that the woman was consenting, and could just judge for themselves whether or not a woman was into it:

Affirmative Consent: In the past, a man could reasonably infer that a woman was consenting to intercourse based on her behavior. Now, the woman must give affirmative permission through “words or overt actions” – although there is a lack of consensus regarding which specific overt actions constitute consent.

HERE IS AN IDEA, DUDES: If you’re not sure, you can ask! It’s not even that hard. The woman is right there, in front of you. Just ask. Like you would with basically anything else you do in life that involves another person, other than, apparently, sticking your dick inside of them.

Families Advocating for Campus Equality is a group formed by mothers of sons who have been accused of sexual assault, who are very sad that all these mean women ruined their sons’ bright futures by accusing them of sexual assault, which they know for a fact their good boys never would have done.

They’ve got a swell website on which they claim that being falsely accused of rape is just as harmful as actually being raped.

Falsely accused students suffer emotional trauma similar to that of rape victims, and yet receive no emotional support from their colleges. A falsely accused young man described his emotions in comparison to that of a female friend who had been raped:

“One important difference, though, is that when she was violated, she received a great deal of help (medical, legal, psychological). Apart from family and friends, I was on my own. My legal and psychological problems had to be dealt with by me at a time when I couldn’t eat, sleep, or think (except, of course, about killing myself).”

Now, I’m not going to suggest that it is 100% impossible for anyone to be falsely accused of rape, or that being falsely accused of rape would not be a traumatic experience. But maybe don’t compare it to actually being raped? Because at the end of the day… they still were not raped.

The other group coming to the Women Lie About Rape Tea Party, the National Coalition For Men, has been around since the ’70s. Usually their big thing is putting an end to unfair Ladies’ Nights at bars where women get free admission (even though the point of them is actually to round up a bunch of women and get them drunk so that men can hit on them), and suing companies for having “women’s only” networking events and the like.

Oh! And Harry Crouch, president of the National Coalition, had this charming thing to say about Ray Rice beating up his fiancée:

“I’m not saying he’s a good guy. But if she hadn’t aggravated him, she wouldn’t have been hit. They would say that’s blaming the victim. But I don’t buy it.”

So, uh, you know where he stands on stuff. Why are women always forcing men to beat and rape them? It is a mystery!

Of course, this “campus false accusation epidemic” is hardly what it seems. Even among those who are actually found guilty of sexual assault by school administrations, fewer than 30% are even expelled from school. Meanwhile, the majority of those who are raped never report their assaults, and many survivors end up leaving school themselves, unable to deal with what the school and their fellow students put them through as a result of reporting.

Contrary to popular belief (among idiots), reporting a rape is not actually all that good of a time! No one I know who has ever reported a sexual assault has gone “WOAH, best time ever! 10/10, would do again! I hear if you report nine false rapes, on the tenth one they give you a free toaster oven!”

It’s not surprising that Betsy DeVos has chosen to give her attention to these groups rather than groups representing sexual assault survivors, but it’s still pretty fucked up.

    Charming daughter o’ mine works in criminal justice/sexual assault support. You can’t even imagine. No, really. You cannot.

    Imagine I rape someone today (and imagine also that my daughter does not catch me, neuter me, and then exterminate the eunuch). Within 72 hours, I will have a lawyer, paid for at someone else’s expense. The victim? On his or her own… and, in fact, my state-paid attorney will soon be out in the bushes, raising dirt and smoke.

    Add to this disparity of representation the very real possibility that the victim is in a demographic that’s naturally hesitant to step forward: trans, gay, homeless, addicted, etc. and add to all that, poor. Know what many victims in our community need first and most after reporting an assault? Access to clean clothes. Then transport at their expense to the nearest state-approved clinic or hospital for rape testing. Really basic stuff, none of which is provided by my state.

    But, yes please, Betsy, let’s focus on how stressing this whole thing would be on me.

      This is one of those things that I just can’t wrap my head around. I’ve literally never had to wonder if a woman consented to have sex with me – because in cases where I wanted to make sure (such as the first time), I would fucking ask if she was sure. It’s not rocket science.

      Where I live the law used to required the man “had grounds to believe she was consenting”. Not reasonable grounds, just any grounds.

      I remember the case where the defense was “her ex told us she liked it rough”. She fought back hard enough she had her arm broken in addition to the violation, they got off.

      Our law has now changed.

    She just wants colleges to handle it like BYU and Baylor did, where the victims were often brought up on honor code violations and punished for their behavior, Title IX investigators were sidelined or stripped of any power, and the campus police actively reinforced the structure that women were guilty until proven innocent.

    The National Coalition for Men, which was founded in the 1970s, has a long history of what is now known as “men’s rights activism.” One of the groups’ chapters published the photos and names of women, while calling them “false accusers.”

    I get that Betsy DuVos is a wingnut who wants to milk the education system for profit, but why the fuck does she think meeting with these fucking people is a good idea? What possible policy goal does that promote?

          It’s not so much taking police power away, but trying to run them in parallel with the administrative side. Police and prosecutors have a higher standard of proof, and there are times where what happened may not rise to the level of “provable in court to be a violation of criminal law” but does meet the “provable by the preponderance of the evidence to be a violation of university policy” standard.

    Researchers estimate that somewhere between 2 to 10 percent of rape allegations are false, but even among those who are falsely accused, it’s rare for men to end up in prison as a result. For students who are found responsible for sexual assault, only 30 percent were actually expelled, according to a 2014 Huffington Post analysis of data from over 100 schools.

    But that hasn’t stopped FACE. One of its founders, Sherry Warner-Seefeld, told the National Review that on the whole, she found it “dangerous to our country” to require universities to conduct annual surveys on sexual assault and publish the results online.

    FFS, correct me if I’m wrong, but we’re not talking about publishing the names of the accused here–just the reports of sexual assault. How the fuck is that dangerous to our nation?

    I have read exactly ONE (1) account of a guy being ‘falsely’ accused of rape where the guy sounded believable. Whether or not that particular account was true, I have no idea. But I’m sure it does happen, now and then. You know, like, rarely. Seldom. This is totally unlike actual sexual assault – that’s distressingly common.

    You can’t base policy on the exceptions; you base it on the patterns. I don’t know if DeVos is really too stupid to realize that, or if she’s doing this to make her patriarchal, evangelical, retrograde base happy. Probably both.

When the motive is revenge or attention, they try to keep it in their small communities, where they can both control the situation and benefit from the attention.       I remember Pro Publica doing a story on a woman who recanted and confessed that her rape accusation was false. It later turned out that she was 100% correct and had been bullied into her ‘confession’ – the rapist (discovered after raping other women) even took pictures on a camera that was found in his home. There was no reasonable doubt that it actually happened.

    the UT System released the results of a survey of 13 of their 14 general academic and health related institutions last year. they’re hoping that everyone in the country takes this seriously because you don’t get these cross system results just “because: Texas”. the survey also helped get a package of campus sexual assault bills passed by Sen. Kirk Watson (D – Austin) and Sen. Joan Huffman (R – Houston) last spring. I must mentioned that during the hearing there were a few Sens. Men (R – MRA) who have not been fully briefed on how sexual assault investigations are conducted and thought that even being investigated could lead to stigma toward the accused. this is obviously not the case and, though we didn’t get the whole package passed, we got several of the bills because Men (R – MRA) do not make up the majority in the Pink Dome.

        I actually think that’s lowballing it. A few years ago, feeling curious after some Massive Rectocele Arrangement declared that rape/SA stats “pathetically overblown”, I informally surveyed women I knew.

        Limiting the definition of “sexual assault” to “unwanted physical contact of a sexual nature” I asked online and offline acquaintances, from a variety of backgrounds, nationality, age, sexuality, etc.:

        1. Have you ever been sexually assaulted?

        2. Has it happened more than once?

        3. Did you know the perpetrator?

        4. Did you report it to the police?

        5. Was the perpetrator prosecuted?

        6. Did the assault leave you with persistent mental or physical health issues?

        Of 87 women (including my wife and I) only one said she’d never suffered any type of sexual assault, only sexual harassment. Roughly two-thirds had been victimised more than once.

        Virtually every survivor knew her attacker, only ten police reports were ever made (from roughly 300 total assaults), and only one ended in a conviction (community service and an alcohol awareness class). The attack had a male witness, which almost certainly accounted for the conviction.

        Most of my acquaintances reported lasting psychological symptoms. They ranged from social anxiety, and agoraphobia, to self-harm, depression and C-PTSD. Some were unlucky enough to contract STIs

        But, y’know, it could be worse, we could be poor ickle menz, who only rape because the ~females~ ask for it 😭

    That is, of course, ignoring the fact that false rape accusations barely make it to step A to begin with, and are also a hell of a lot less likely to even occur than actual rape.

    falsely accused of rape would not be a traumatic experience. But maybe don’t compare it to actually being raped? Because at the end of the day… they still were not raped.

    The fact is a small number of disturbed individuals with unresolved issues can be the source of false accusations, not just rape, all sorts of paranoid bullshit. And the best way to eliminate these false positives is with trained law enforcement personnel and/or counsellors, who know exactly what to look for, NOT treating all victims “guilty until proven innocent”.

    I’m not normally one to victim blame, but in this case it seems appropriate. If you don’t want to be falsely accused of rape, there are some simple steps even the most inebriated frat boy could follow.
    1. Don’t be an asshole.
    2. Set clear expectations about what you want out of any sexual relationship. You’d be surprised how many college-aged women are DTF without the entanglements of a relationship, provided you’re clear about what you want and revisit rule #1 regularly.
    3. Be respectful. Yes, this includes keeping your mouth shut afterward.
    4. Get to know the person you want to have sex with well enough to determine her mental stability. The process of reporting and prosecuting a rape is so humiliating and invasive, only a deeply unstable person would make up being raped.

    As for avoiding the far more likely scenario of being accused of rape because you actually did rape someone, that’s even easier to avoid! Don’t rape!

      When you as a nation elect a person who considers the ability to commit sexual assault and harassment without consequence to be a useful byproduct of fame, you cant pretend to be surprised when the people he hires begin to extend that theme as the new ‘normal’. Trump is a liar, criminal, thief and repeated oathbreaker. In his first ex-wife’s autobiography, she clearly describes being raped to anyone who doesnt have a settlement with a ‘non-disclosure’ clause.

      We elected a rapist as President, not for the first time. Rape is probably a primary reason for the long term popularity and success of slavery in the US for nearly 200 years (before its abolition). One of our most well regarded Presidents was a slaveholder and rapist. ‘Fun’ trivia fact, every single person electrocuted for the crime of rape in Virginia was a black male convicted of the rape of a white female.

      When a plurality of this nation is willing to accept a person as vile, uneducated, ignorant and sociopathic as Trump to be President, you shouldnt be surprised when rape culture and race baiting rear their ugly heads.

  • People like Betsy DeVos are the reason I never reported it when it happened to me. It’s not *just* the virulent MRAs that are the problem. It’s the “reasonable” people who maybe don’t make harassing rape victims their life’s work, but think that the guys that do have a point.

      Most of these are moms that have sons who were “falsely accused.” It’s one thing for a person to vigorously defend their offspring (I do, though I don’t have boys). But they made it their lives’ work, which means they believe their sons’ experiences are universal. (FACE lady has 4 sons and 0 daughters – I wonder if that’s relevant). And that’s just vile.

      Bingo. This. Absolutely this. Sadly, in the geek/fandom circles I travel in, this is all too common and it’s just infuriating. Because it’s always the same stuff: “But what about the reputation of teh menz?” “The Middle East is a real rape culture.” “Innocent until proven guilty!”

      My response is always as simple as this: “Did you see that movie Spotlight? That’s what rape culture looks like. Whether it’s harassment, concealment, legal strong-arming, a casual wink and nod, or even merely a disapproving glance cast towards a victim, it’s about whatever it takes to enforce silence.” Father Geoghan didn’t need to go out of his way to harass his victims because he knew that his position of authority granted him the benefit of the doubt. “A priest is a man of God! How dare you impugn the good name of a holy Father?!” The church hierarchy didn’t want to hear it, the community didn’t want to believe it, so move him to another parish and wash your hands and the cycle continues. This is why Marty Barron (the Liev Schrieber character) was insistent that the Spotlight team get “the system”, because it’s there’s always more to the story of sexual assault than just one rapist.

      This is a key point to remember for anybody coming into this discussion for the first time: the MRA conceit when it comes to the image of somebody “falsely” accused of rape is some poor schmo who just got the wrong signal when getting frisky with a partner. This conceit is bullshit. Again, remember Spotlight. Rapists are repeat offenders well aware of their power and willing to take advantage of it. Whatever objections these people have to obtaining consent, it’s because they want to game the system for plausible deniability. It’s as simple as that.

      Fighting a system is tough. I’ve got dirty looks from my fellow geeks for objecting to their talking points. It’ll cost relationships. It’ll reveal uncomfortable truths. But it’s damned necessary if we want to do what’s right.

    Women like Betsy DeVos don’t have a problem with the “wrong” types of women being raped. It’s not that men are being falsely accused. It’s that they do not think rape should always be illegal. Some women are fair game. Rape is a way to get women in line. When our fathers, brothers and husbands can’t control our freedom of movement rapists can help. When all rape is illegal us women can move about a little too freely for the likes of DeVos and other traditionalists.
