Oh hi, we are here with another dispatch from America, land of the Racism Is Totally Over, Yep, You Bet. It’s a story as old as Phyllis Schlafly. Black lady by the name of Kamilah Brock (“Kam” for short) gets pulled over in Harlem for the violent road crime of dancing in the driver’s seat while she’s waiting for the light to change. Maybe she was doing the Nae Nae, like Hillary Clinton! Anyway, she was OF COURSE taken into custody, because you never know what a black lady is going to do if you let her go. (Sometimes, they’re rushing off to care for their sick patients, because they are doctors!) Once police had kept her at New York City’s 30th precinct for a few hours, they said “Bye!” and told her she could come get her car, a 2003 BMW 325CL, out of impound the next day. So she went back and got her car and took it home, and she never made the mistake of driving while black again, the end.

JUST JOSHING, THIS STORY IS SO FUCKED, OH MY GOD WHAT IS WRONG WITH THIS COUNTRY?

When she showed up at a police substation to get the car the next day, Brock said, “I just felt like from the moment I said I owned a BMW, I was looked at as a liar. They put me in handcuffs and said they just need to put me in handcuffs to take me to my car. And I said OK, whatever it’s gonna take to get to my car.”

“Then EMS approached me,” she continued. “And they said we’re gonna take you to your car. And I’m like, in an ambulance? I’m going to my car in an ambulance? I’m going to my car in an ambulance? I was just so confused.”

We are too! Because instead of being taken to her BMW, Brock was taken to the mental ward at Harlem Hospital, because do you hear what this lady said? She said she has a BMW. (LOL!) She said she’s a banker. (LIKELY STORY, LADY.) She said the president follows her on Twitter. (He follows a metric fuckbucket of people on Twitter, though we’re curious how that detail came up.) And according to Brock’s attorney, Michael Lamonsoff, all that stuff is true. (GIMME A BREAK, DUDE.)

Lamonsoff also said that Brock has no history of mental illness, which makes a person wonder why hospital staff felt the need to sedate her, give her lithium, or do this thing:

“He held onto me and then the doctor stuck me in the arm and I was on a stretcher and I woke up to them taking my clothes off, specifically my underwear,” Brock tearfully recalled for PIX11’s Nicole Johnson. “Then I went back out again. When I woke up the next day, I felt like I was in a nightmare. I didn’t understand why that was happening to me.”

And of course, just to make it extra fun, after eight days in the psych ward, she got slapped with the bill, $13,000 to be specific. Is she suing the city? Fuck yes she is. When the suit was filed earlier in the summer, the NYPD responded that at the time of the original stop, which happened last September and about which Brock is only now speaking publicly, she had been “acting irrational, she spoke incoherently and inconsistently, and she ran into the middle of traffic on Eighth Ave.”

So, huh. MAYBE there’s more to the story, but even then, boy howdy, that’s quite a leap to go from a traffic stop on one day to being straitjacketed into the mental ward by the po-po the next day. Or maybe there’s not more to the story and this is just another example of how good America’s police are at serving and protecting black people.

    Why did NYPD not go by their standard procedure when encountering a person of the black persuasion driving a nice new BMW? From what I understand, they’re supposed to shoot the car with about 200 bullets from nine different directions, not haul the driver off to a mental hospital like she’s some kind of white person with the right to live. I’m very confused here.

        Once when I was working in Connecticut, one of my contractors showed up at our meeting place, followed by a cruiser which then proceeded to block us all in. They had decided that he was driving a stolen car because the CT DMV sucks (it was a new car and the DMV hadn’t completed the registration) so they searched it, found a pipe (no pot) and then arrested him.

        When I asked why they ran his license plate in the first place the other two contractors were like, well we’re in West Hartford (a very rich community) and he’s from New Britain (adjoining poor town) driving a new car…

        he wasn’t even black, they just saw he had come from poor town and decided to check him out.

Last week I walked out Asylum Ave (yes that’s the name!), past the Mark Twain House until I got to Whole Foods and the Cheesecake Factory which is West Hartford of course. I got a loaf of bread. As I walked away, I was not arrested Les Misables style, for some reason. Oh yeah: Because I’m white.

      I’m fully in favor of her getting her due, because JESUS, that’s one fucking awful way to be treated for the reason of blackness. But here’s the thing… the asshole cop (cops?) and the rest of the establishment that decided this lady needed to be locked up, they don’t pay out-of-pocket for these damages. The citizens of NYC get that privilege. Hardly seems fair, since I wager Ms. Brock, her black friends, and her family all are part of the pool of taxpayers from which this settlement must be paid.

    Then, when she made her way back to the substation, acting all sane and normal and shit, but still being black and owning a BMW, she is THEN taken into custody.

    I assume if she was truly acting irrational when they arrested her there is video of it somewhere. If not, well, I hope she sues and wins and buys a Lamborghini to tool around in.

    does the 5150 hold vary from state to state? I thought they can only hold someone for 48 (or was is 72 hours) in a mental ward? How did they get away with 8 days? She’s lucky to get out. once you’re in that system it’s hard as hell to get out.

      In NYS there’s a few ways. The 979 will get you in the door, and then two psychiatrists can evaluate you and hold you under a 2-PC, but you can challenge that in court (with a provided advocate for you). It does take time to schedule the court hearing though.

          If you’ve got 2 corrupt psychiatrists, it could be. The state office of mental health (OMH) is pretty strict about making sure you’re not doing it wrong though. The in-house patient advocate usually sees people the same day they issue their challenge, or the next day at the latest, and if they don’t agree with the hold the docs usually rescind it pretty quickly rather than go to court. 8 days seems long to me, there’s definitely something more to this story, though I can’t see what at this point.

          • I will offer this very, very pale defense of the doctors. If they’re underworked and they’re handling some lady (who by the time she got to them would have been incredibly agitated) and were told by the police that she’s delusional, a combination of implicit bias and overwork, rather than outright corruption, would lead them to look no further than getting this patient processed quickly. So, they probably didn’t twirl any mustaches, but they did a very bad thing.

    Also too, I would guess that Harlem Hospital is not staffed by the KKK…

    I’m going hold off on my outrage on this one until more is known.

      Something is very rotten in Denmark. I can totally see the cops carting someone off for little or no reason, but for the psych hospital to hold her for 8 days there was something else going on.

        They were trying to get her to admit she is unemployed, that Obama does not follow her on Twitter, and that she doesn’t own a BMW. I forget what reasoning they gave for releasing her but I think it was something like “Listen, mentioning anything about this little misunderstanding would be a totally classless thing to do on your part.”

    • Are you familiar with Adrian Schoolcraft? He’s a former NYPD officer who gathered evidence of corruption within the force and in retaliation was forcibly admitted to a psychiatric hospital where he was held for 6 days. This was way, way back in the Serpico days of 2009/10. So, that combined with the fact that I’ve seen tons of bankers in this town behave in a totally unhinged way and not get arrested makes me disinclined to believe the NYPD.

        A crash course on the NY Mental Hygiene Law says you are correct.

        The fact that she was held for eight days means a licensed psychiatrist certified that she had “a mental illness which is likely to result in serious
        harm to self or others and for which immediate observation, care and
        treatment in a psychiatric center is appropriate”.

        While a black woman driving a BMW and working at a bank is certainly threatening to some fragile minds, I’m thinking that if this story can be taken at face value, at least one physician needs to be losing his license to practice.

    Just considering this, so you hold someone for a few hours for behaving ‘erratically’ and then let her go only to arrest her and toss them into the nut hut the following day when she came to pick up her car? Here’s a question I’d like to ask the NYPD, if she was dangerous enough to warrant involuntary commitment to a psych ward why did they let her leave the station and go home? They tend to not just toss anyone into the psych ward willy nilly and generally there has to be evidence through thought or action that the individual can potentially harm themselves or others and yet she was fine to go home….no something reeks of this and some heads need to roll an apology needs to be made and she needs to be compensated.
    If they had sent her directly from the station to the psych ward based on ideation or actions there would be no story here but this…this is bullshit.

      Exactly. The idea that ANYTHING she did during the traffic stop had any bearing on what happened the next day is ridiculous. Are they suggesting that when she walked up to the impound clerk’s window and said she was there to pick up her car, he had access to the detailed traffic stop report and made a command decision?

      To be fair though, I highly doubt this happened for no reason, or because a black woman claimed to have a BMW. She probably just has an oddball exuberant personality and you know authoritarians have trouble relating to that.

    Even the wild ass reasons the police fabricated don’t explain the bizarre treatment this woman experienced at the hands of law enforcement, They can’t possibly say, Yeah, we arrested her for being happy, and that was irrational behavior so we threw her down and stuck her with a needle and whisked her off to the psych ward.
