Did we not provide enough coverage of the Hot Scandal last week? Okay, here is comprehensive coverage: Obama made the typical politician comment, “The Supreme Court would be wrong to overturn the law that I don’t want overturned” or what have you, and everyone on the right went “THAT’S NOT TRUE, YOU ARE DUMB.” Why can’t this President understand that his preferences and opinions are always factually wrong? He should have been teaching the class “I Am So Dumb 101″ at law school instead of constitutional law, most of which he has burned.

Senator Grassley and the others who are criticizing Obama on this issue have no fucking clue what the President was talking about. Marbury v. Madison established the principle of judicial review (i.e., the duty of the court to rule on whether HCR is unconstitutional.) Obama was talking about judicial activism (i.e., rendering a ruling based on a justice's personal opinion rather than on the constitution.)
These are two very different topics, although in the heated political climate of today it's not surprising to see the Republicans try to conflate those two. And it would take a very activist court (more so) to rule against HCR. The question about the constitutionality of the individual mandate to get health care insurance is truly trumped up. That idea originated with the Heritage Foundation (gee, we didn't hear from the right wing about constitutional issues when *they* were promoting it, did we?) Moreover, two conservative appeals court judges said the law is indeed constitutional.
Here's hoping Am ppl r not stupid enough to fall for this crap…

The Right has been screaming about the evils of judicial activism since at least the 1950's when "Impeach Earl Warren" billboards appeared all over America, but when my President says that it would be wrong for the SCOTUS during its judicial review of the AHC Act to ignore established legal president, Greta Van Sustern and other right wing racists try to turn it into an attack on judicial review, which it never was.
