Speaking of Jared L. Loughner, who is accused of being the gunman, he said, “Saying anything about him would be a waste of breath. Recognizing his existence is a waste. I don’t like his face.”

In the first days after the attack, his anger seemed especially strong. In the interview, he repeatedly denounced the “Tea Party crime syndicate,” and said he placed some of the blame for the shooting on Sarah Palin and other Republican leaders, saying he believed they had contributed to a toxic atmosphere.
So his crime here is being explicit, whereas Obama was “GABBY OPENED HER EYES! THE NINE-YEAR-OLD’S ANGEL TEARS WILL SAVE US ALL FROM EACH OTHER! GABBY OPENED HER EYES!” in talking about the bitter polarization. You apparently are not allowed to be uncivil about incivility either.

Almost every state has a "making threats" law, which can basically be manipulated by law enforcement since all it requires is that the threat be "credible." For example, I know of a case where a guy got mad that his brother was in jail, got shit faced and called the police station to vent, including a threat to kill all of those motherfuckers. Although I doubt that anyone thought he was really going to do it, it was a convenient excuse to arrest and detain a person who'd been a huge pain in their ass and cool him down.
Here, I'm guessing it was the man's demeanor that got him arrested, mainly so they could get his fairly evident PTSD issues diagnosed. Should cops have arrested a whole lot of TeaBaggers last year during the Town Hallls if they were applying the same standard? Yep, but that was just harmless "talk", don't ya know. In any event the 72 hour (California calls it a 51-50 hold, I don't know what other states do) will probably be followed by the charges being dismissed/decline to prosecute.

I'm guessing that it's entirely possible that this wasn't the first time he was shot. He's about the right age to have served in Vietnam and may have been wounded there. If so, he's going to be justifiably angry about being shot again.
